Terms of Service
Thank you for choosing YourTales, a mobile app developed and owned by YourTales, LLC ("YourTales," "we," "our," or "us"). YourTales allows users to create custom kids' bedtime stories using artificial intelligence technology powered by Chat GPT ("the Service"). The following Terms of Service Policy ("Agreement" or "Terms") governs your use of the Service.
Please read this Agreement carefully before accessing or using the Service. By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these Terms, you may not access or use the Service.
License and Use of Service
YourTales grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for the purpose of creating custom kids' bedtime stories for your personal use only. You may not use the Service for commercial purposes without our prior written consent. You acknowledge that the Service may be subject to limitations, delays, and other issues inherent in the use of the internet and electronic communications.
2. Eligibility
To use the Service, you must be at least 18 years old or the age of majority in your jurisdiction. If you are under 18 years old or the age of majority in your jurisdiction, you may only use the Service with the consent of your parent or legal guardian.
3. Privacy Policy
YourTales' Privacy Policy is incorporated into this Agreement by reference. Please read the Privacy Policy carefully before using the Service.
4. Intellectual Property
The Service and its content, including but not limited to text, graphics, images, logos, software, and code, are the property of YourTales or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, display, modify, or create derivative works of the Service or its content without our prior written consent.
5. User Content
By using the Service, you represent and warrant that any content you upload, create, or otherwise provide through the Service ("User Content") does not infringe on any third-party intellectual property rights or violate any applicable laws or regulations. You retain ownership of your User Content, but by providing it to us, you grant YourTales a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, store, and display your User Content in connection with the Service.
6. Prohibited Conduct
You agree not to use the Service to:
(a) Engage in any activity that is illegal or violates any applicable laws or regulations;
(b) Infringe on any third-party intellectual property rights;
(c) Upload, create, or provide any content that is defamatory, libelous, obscene, or offensive;
(d) Use the Service to harass, threaten, or intimidate others;
(e) Attempt to access, tamper with, or use non-public areas of the Service or our computer systems;
(f) Introduce viruses, worms, or other harmful code into the Service;
(g) Use the Service to send spam or other unsolicited messages;
(h) Collect or store any personally identifiable information from the Service without our prior written consent; or
(i) Impersonate any person or entity or falsely represent your affiliation with any person or entity.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. YourTales does not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful code.
8. Limitation of Liability
IN NO EVENT SHALL YOURTALES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, USE, DATA, OR OTHER INTANGIBLE LOSSES, WHETHER OR NOT YOURTALES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOURTALES' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE APP SHALL BE LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, TO YOURTALES FOR THE APP.
9. Indemnification
You agree to indemnify, defend, and hold harmless YourTales, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or in connection with your use of the App, your user content, or your violation of this Agreement.
